Edward Harrington: Selected Verse
Despite a reasonably diligent search, the owner or owners of copyright in the original poems by Edward Harrington included in Edward Harrington: Selected Verse could not be identified and located. This notice is given for the purposes of Division 2AAA of Part V of the Copyright Act 1968 (Cth).
This notice concerns the underlying copyright in Edward Harrington’s original poems. It does not concern copyright in the introduction, original editorial material or published edition.
The search for the copyright owner
Copyright in Harrington’s poems is understood to continue to subsist until the end of 2036.
Blade Shed Books has undertaken and documented searches to identify and locate the copyright owner or owners. Those searches have included probate and testamentary records, genealogical and archival sources, historical publications and library records, as well as correspondence with people who might reasonably have information concerning the ownership of the rights.
The searches have not enabled the current copyright owner or owners to be identified and located.
Persons have subsequently asserted ownership of the copyright. Blade Shed Books has requested information or documentation establishing the relevant chain of title or authority. To date, no person asserting ownership has provided documentation establishing such a chain of title.
The fact that a work remains in copyright does not, by itself, identify its copyright owner. Similarly, family relationship to an author may be relevant to an inquiry into succession, but does not by itself establish present ownership of copyright.

Why the book remains available
Edward Harrington: Selected Verse was published to return the work of an important Australian poet to readers, schools, libraries and researchers after much of his poetry had been unavailable in print for decades.
Division 2AAA of the Copyright Act 1968 addresses circumstances in which copyright material remains protected but the copyright owner cannot be identified and located despite a reasonably diligent search. The Division provides for a limitation on remedies where its statutory conditions are satisfied, including requirements concerning search, record-keeping and notice.
In circumstances where the copyright owner or owners have not been identified and located despite the search undertaken, Blade Shed Books intends to continue making Edward Harrington: Selected Verse available with notice given for the purposes of Division 2AAA.
Should a copyright owner be identified and establish their ownership, Blade Shed Books will deal with that person promptly, respectfully and in good faith.
